THIS AUTHORIZATION AND RELEASE is made by participants for the benefit of the “LADIES, LET’S
GO FISHING!” (R) Seminar produced by Metro Media Marketing, Inc., a Florida corporation ("seminar"):
WITNESSETH:
The Seminar sponsors a fishing experience which utilizes a system of placing individuals aboard the
vessels of boats for the purpose of allowing the individual to learn various fishing techniques and
Tthe Participant attends other seminar activities for the purpose of learning fishing.
For and in consideration of the permission granted to the Participant by the Seminar to be placed
aboard a vessel participating in the Seminar, the Participant does hereby absolutely release, waive,
discharge, covenant not to sue, and agree to indemnify and hold harmless the Seminar, its sponsors,
Ladies Let’s Go Fishing Foundation, any Foundation Board Members, MetroMedia Marketing Inc, any
employee or part time contractor of MetroMedia Marketing Inc, its officers, directors, employees,
agents, partners, and servants, and subsidiary and affiliated companies or organizations, of the
Seminar, and their respective predecessors, successors, and assigns, and all their past, present, and
future officers, directors, and agents, employees, and partners, directly or indirectly affiliated or related
to the Seminar, and their past, present, and future officers, directors, agents and employees from all
liability to the Participant, his/her spouse, children, legal representatives, heirs, successors, and
assigns, for any and all losses or damages, and any claim for damages resulting therefrom on account
of death, personal injuries, virus or sickness or property damage sustained by or caused by the Participant whether
caused by the negligence of the Seminar or otherwise, while the Participant is aboard the vessel of any
Participant in the “LADIES, LET’S GO FISHING!” Seminar produced by Metro Media Marketing, Inc. activities or while upon the premises of any “LADIES, LET’S GO FISHING!” Seminar produced by Metro Media Marketing, Inc., affiliate during the Seminar event.
THE PARTICIPANT EXPRESSLY ACKNOWLEDGES AND AGREES THAT THE ACTIVITIES
WHICH INVOLVE OFFSHORE FISHING ARE VERY DANGEROUS AND INVOLVE THE RISK OF
VERY SERIOUS INJURY, DEATH, AND/OR PROPERTY DAMAGE. THE PARTICIPANT ALSO
EXPRESSLY ACKNOWLEDGES AND AGREES THAT THE SEMINAR HAS MADE NO
REPRESENTATIONS OR STATEMENTS OF ANY KIND WHATSOEVER CONCERNING THE
CHARACTER OF THE VESSEL WHICH THE PARTICIPANT WILL BE ABOARD AND PARTICIPANT
ALSO EXPRESSLY ACKNOWLEDGES AND AGREES THAT THE PARTICIPANT HAS BEEN TOLD
BY THE SEMINAR PRIOR TO RIDING ABOARD ANY SUCH VESSEL THAT VESSELS, AND OCEAN
FISHING, IN GENERAL, ARE UNPREDICTABLE AND THAT A PARTICIPANT MUST AT ALL TIMES
PAY CLOSE ATTENTION TO THE VESSEL AND TO THE CONDITIONS AT SEA. NEVERTHELESS,
PARTICIPANT INDEMNIFIES THE SEMINAR FROM ANY LOSS, LIABILITY DAMAGE, OR COSTS
THAT SHE/HE MAY INCUR DIE TO THE PRESENCE OF PARTICIPANT IN OR UPON THE AREA
OR PREMISES OF THE VESSEL IN WHICH THE ACTIVITY WILL OCCUR, WHETHER CAUSED BY
THE NEGLIGENCE, INCLUDING GROSS NEGLIGENCE, OF THE SEMINAR, PARTICIPANT, OR
OTHER PARTICIPANTS IN THE BOATING OR FISHING ACTIVITIES.
Participant hereby assumes full responsibility for the risk of bodily injury, death, or property damage
due to the negligence of the Seminar or otherwise while Participant is in or upon the vessel or the
property in which the activity will occur or for any other purpose.
Participant also releases rights to any photos or videos taken of Participant during the seminar's
events, which may be used for brochures, publicity photos, or any other purpose as deemed by
Metro Media Marketing, Inc.
Participant expressly agrees that their Release is intended to be as broad and inclusive as permitted
by the laws of the State of Florida, and that if any portion thereof by held invalid, it is agreed that the
balance shall not withstanding, continue in its full legal force and effect. Participant further releases the
Seminar from any claim whatsoever on account of first-aid treatment or services rendered during
Participant's participation in the activities.
This release form does not exculpate the seminar, its agents, its sponsors, and or employees for
willful and wanton acts of the Seminar in injury, damage or mishap to the Participant. Participant agrees
to indemnify and hold seminar harmless for any and all claims, damages, causes of action, liabilities
and obligations asserted against or incurred by the Participant (including without limitations, for all
attorney fees actually incurred by or chargeable of the Seminar, whether or not suit may be brought or
any appeal by taken therefrom) by virtue of the misconduct or negligence of the Participant.
